:( On February 2, 2007 I signed a hand written agreement to purchase a mobile home for $14,995. I placed a deposit of $500 down on the home which is in a mobile home park. The mobile home park rents the lots for the homes. Doesn't that make the mobile home personal property only? I've found out after the fact that the park does not allow dogs over fifteen pounds and mine weighs 65 pounds. I know that other renters have dogs in the park that do not fall within the rules. I was twice told by the seller to basically sneek my dog in later and hope for the best. I do not wish to bend, break any rules which were confirmed by the park manager. I was also told by the seller that they did not know of such a rule. I had the unfortunate news to tell the seller that I would not be able to buy the home under those circumstances. I have been told by the seller that they would get to keep my $500 deposit even though it was not written into the agreement. Since then I still have not been able to obtain financing for the home. Is there any recourse for my problem?

Are you trying to buy the home or not? It appears that you are not, but then you say you're still trying to finance the home.

In reality I had a close date on the 20th of February but at that time I had only received part of the money to puchase with. I asked for more time and was granted until the 26th Feb. During this time I found out about the dog issue which neither of us knew about because there are many dogs in the park over 15 pounds. It was only after I talked to the park manager and comfirmed with the management company out of state. I told the seller the information and they said they didn't know about it either. Isn't it a mistake made by both parties? They said to bring the dog in later. I tried to explain to the seller that I cannot and will not move into the park and start breaking the rules. They didn't care.

I suspect that any court would deem it your responsibility to investigate community rules, and the issue of the community rules as separate from the sale of the home. (The home sale is separate from the lot rental.)

I remember that the seller said they would have to get their sister to sign the title because the sister had power of attorney, but they signed their own name on the contract. Would that not make the contract null and void?

Have a lawyer review the contracts and title work.
