    Can You Obtain a Protective Order Against a Parent Who Attempts Suicide
    I'm in KY. I'm at a loss of what exactly I need to do...

    So the mother of my two children tried to commit suicide by OD. I was told she took handfuls of pills while the kids was with her. The police came and stopped her and took her to a hospital. This is a dangerous environment for my children. For both mental and physical health. What do I need to file to protect my kids? I was told EPO from family court? But it was rejected! Do I need a ECO? Or something else I don't know about I need help. She's said before about crashing off the road to die with the kids! I don't want them to be hurt or find her with pills everywhere with no way to care for them self's or no way to contact help

    You need to be talking to a lawyer. I suspect that the court was unimpressed with the "emergency" aspects and you need to pursue a normal custody change.

    I don't know what ECO means. Did the court schedule a hearing for the Protection Order? did you submit your evidence to the court? The judge is neither likely nor expected to grant an EPO unless the petitioner submits competent evidence.

    ECO = Emergency Custody Order.

    If you want to suspend mom's visitation (or modify custody), then by all means file a motion with the custody court. We are not in a position to evaluate whether the incident remains of sufficient import so as to justify the grant of an emergency order -- that's a decision to make after consulting a local lawyer who can advise you based upon the full facts of the situation and the case history.

    ECO = Emergency Custody Order. Again, understand that in order to get "emergency" anything in the court, you have to show that the failure to issue precludes any other remedy and this emergency outweighs any legitimate rights of the other party. You mgiht have a case, but the court isn't seeing the emergency part.

    Was CPS contacted when law enforcement found she had overdosed with the children there ? How old are the children ?
