What to Do if Your Ex-Girlfriend Threatens Your Life
My question involves criminal law for the state of: Alabama
Hey everyone,
My ex girlfriend threatened to Shoot me in the head, burn the house I am living in down and hire someone to kill me. Cops came and they couldn't do anything that evening and they told me to go file for a Restraining order and go to Magistrates office.
The following day I go and get an Order and its an Ex Parte Protection from abuse. She must surrender all firearms, stay away 1000 feet and stop contacting me. She has been contacting me all week and she finally got served and continued to contact me. She said she would pay me 1000 and 2000 to drop it. From my understanding that is bribing a witness, but I am not sure.
Also, I have a warrant out for her arrest(hasn't been filed yet for some reason) for third degree harassment. I recently learned that threatening to hire a hitman is not a felony, GREAT. So, she is still out there walking around and she just bought a ticket to flee to South Carolina because she doesn't want to show up for court to share her side of the story for protection order.
Now, I called the cops tonight and told him everything she said, eg; Paying me to drop it, she's leaving tomorrow etc and he basically laughed and said "call us if she shows up at your house" and left.
She already violated the protection order nearly 100 times by texting me. I do not get why they are unable to do anything. She is suicidal as well, and they KNOW that.
Sorry for the wall of text, I am very overwhelmed and I am fearful for my life. Tomorrow, I am changing my out of state license to an AL license and getting a pistol permit incase she hired someone.
I am unfortunately stuck here in the state until the court date for permanent protection.
P.S. I will be posting thread in Child Custody as well, because she is pregnant.

To make the arrest for violating the protection order, she would essentially have to be on scene. They are not going to call in SWAT and the detective bureau to hunt down a whacked out woman threatening to kill you. It could well be that these assorted allegations are all misdemeanors which could make an arrest unlikely unless or until a court issues a warrant. I suspect they have taken a report of any court order violations, but that does not mean they can instantly file for a warrant. Seeking a warrant through a prosecutors office can be short, or lengthy, depending on the process in place in your county and the severity of the offenses alleged. Out here, if you walk it through, it can be done in a day. Normally, in the larger counties, you're talking about a month or so. In the small and medium ones, maybe a week or two. In any event, tracking the suspect down and slapping her in cuffs is not likely.
If you are truly fearful for your life, then take the necessary steps to protect yourself. But, ask yourself: Does she have the means to carry out her threat? Does she own any firearms? Does she have access to lots of money? Does she run in circles surrounded by violent people who might kill for money? Hiring a "hit man" is not as easy as putting an ad in Craigslist, and aside from TV it's not something that tends to happen much in real life.
If she fails to show for the court hearing on the order, then it should be granted. It's also possible that the court may be compelled to issue a warrant for her arrest for the previous violations, though I suspect that violations are handled in a different court than the one you will be attending.
As for her being pregnant, there's not much you can do about that, so there is no custody issue until after the child is born. At that time, you can file for paternity. In the meantime, perhaps you should consult a Family Law attorney who can tell you what your options might be if you believe she is carrying your child.

You have a warrant for her arrest? How do you have a warrant for her arrest? Or there IS a warrant for her arrest for that crime. You can't file warrants.
Let her flee. That's her problem not yours. Then she's not bothering you. I'm pretty sure hiring a hitman is a crime of some kind.
So what she's pregnant - you don't know it's yours. I would stay as far away from her as possible until you know you have a child with her.

Not trying to hijack this thread, but if I read this right are you saying that a court can issue a warrant on its own behalf in the absence of a prosecutor? If this is true, is this the case for all types of crimes, or just restraining order violations since they can be considered contempt of court order issues?

Unsure if she has any firearms but a couple months back she got into a car accident and she texted me that if she had her gun, she would have shot the guy. Also, the protection from abuse order says she must surrender all firearms. She showed me her bank account showing that she has a sizable amount of money, so that shows that she does have the money to hire someone. A couple of her relatives are in jail for murder.. I am being cautious. Although, I guess that's not really indicative of anything.
As soon as I go to court I am leaving the state(she already left, so I can't even file paternity if I wanted to) In the meantime, I got a pistol permit. The city I live in is an "Uttershithole" that's what the cop told me and he did recommend I get my pistol permit and leave as soon as possible.
When all this happened the police told me to go down to the magistrates office to get a warrant for her arrest for third degree harassment. It is currently pending.
Honestly, all this taught me was that I can go around telling people I am going to kill them and I can walk away with no consequences.
If she wants any type of support, since she is running away from whatever she is, she will have to track me down to find me as I am leaving the state ASAP.

FYI, in some states, a private person CAN go before a magistrate and "swear out" an arrest warrant. I am not sure if the OP's state is one of those.

If the court is notified of a violation of probation, through whatever means might be appropriate, the court can issue a warrant for the arrest of the suspect. I HAVE seen warrants issued from Family Court in my state when the court was advised of violations. I was present in one case where the judge actually told me to go find the defendant (at her home) and arrest her! How it might work in the OP's state, I can't say.

Of course. But is she runs and dodges me, her warrant then decides to show up two years down the road she will have to track me down for it. I am leaving as soon as court is done,that's all I am saying. She can fly under the radar. I am not hiding, she caused this mess. She violated the Ex Parte order and if the Judge follows the book, a couple of felonies will be coming her way. I'm trying to do this the legal way, she is running away from it all.

Hopefully there is no pregnancy...
