Can Marriage Fraud be Proved Based on a Post-Marital Affair
Person A ( legal Visa in the U.S) and Person B (USC) have been dating and lived a few years before getting married. They have houses together and shared bills. They want to share a life together. The relationship and marriage are real. However, a few months later, Person A has an affair with person C. There are messages history of A to C saying "He/She has no choice but getting married his/her bf/gf due to immigrantion issue and asked C to wait."He/She could not get a divorce because of that." " He/She compares B to C and see which one is more suitable for him/her." "She/He is guilty of cheating." "He/She accused C of destroying his/her marriage"
"Even C feels like he/she is a home-wrecker because he/she knows they have been together long." There are a lot statements in the history contradict to each other. Can person A be charged as marriage fraud? Or it can be viewed as an affair /bad marriage ? Person A did not divorce B after getting the permanent greencard. A apologized to B and want the marriage last.

The timing does seem suspicious honestly. It could be viewed many different ways..... Going give my personal non-legal opinion --> Person A needs to get his sh*t together and get out of the affair and work on his marriage or get divorced and deal with whatever immigration issues stem from doing the right thing.

I am not nobody in this mess but my good friend..... it is just messy. I guess there is always no granutee in a marriage but as long as they were wanting to build a life together when they get married. That is all the matter. People make mistakes at times

In my perspective, it is not pseudo. I think people make bad choices in life when it comes to love/feelings. It is just the moment. A bad marriage is not an unreal marriage. They can always work things out if there is true love. I think it's impossible to have a life with someone for many years and there is no love in between. Plus he did not want to leave after getting the greencard and he wants to work out the marriage.
by the way, I did not put this title because it's already assumed it is a fraud. I think a more appropriate title is " Does post martial affair constitute marriage fraud?" Can the moderator change that? I think that's what I put at the beginning.
