How to Resume Visitation in a Custody Case
My question involves a child custody case from the State of: tx
I want to start off by saying in no way am I saying that I am innocent.I am simply wanting to know what my best move would be.
I am divorced and we did not go to set up a standard visitation schedule we basically set one up ourselves . Which is every other weekend and went to the judge and he signed off on it.
Over the span of 10 years there has been some cancellations by both parties and some frustrations ,so us parents are going back-and-forth saying mean things to each other. I have one occasion, out of frustration, said some mean things to my children as well. I did apologize,we have moved on, however, I am trying to start back up visits. The Teenagers are too busy every weekend. I try to be patient and wait for my visit time, nothing comes available. I can't really afford a lawyer. I simply want to see my kids. I don't care if it's every weekend or one weekend a month. The CP says if I get a lawyer she will show proof of mean things that were said in the past (nothing of harming them)and proof I have cancelled a visit before. Will this hurt my chances of a random visit here and there?

If there are changes that require a modification of the schedule you have to go back to court. File a modification of the schedule.
What do you mean by "random" visits? You mean outside the court ordered visitation? That's up to the CP if you get more time than what is ordered. Perhaps you two need to grow up and hopefully you have. You don't have to get a lawyer to file a modification. You could go talk to one and see what he or she says.
Never, ever drag your kids into it. It is not their fault that you and the other parent are divorced.
What do you mean you wait for your visit time and nothing comes available? If the CP is denying you your court ordered time then take that person to court for contempt.

Appreciate your answer. Yes I've grown up. I'm not asking for more time, I'm asking for time period. I filed modification. She didn't come to the hearing. Judge said he couldn't do anything without her. She doesn't go on purpose.

The mom says no. It's her way or the highway. Always has been. The. She turns around and says it's the kids decisions. And of course they say no visit.

It is not up to the children to decide if they want to see you. It is up to mom to make them do as the court order says.

How often in say, the past three years, have you visited with the children?
