    Criminal Possession of a Forged Instrument
    My question involves criminal law for the state of: New York City of: New York

    NYPD Police Officers pull over a car because it is missing both the front and rear license plates. There is a Texas temporary plate affixed to the rear windshield. When the officer approaches the motorist, the motorist states he bought the temporary plates in NY. The motorist lives in NYC and never had a Texas address. The police officer runs the plates and they come back negative. The officer arrests the motorist for criminal possession of a forged instrument? Legal?

    Is the paper temp plate supposed to be affixed to the rear windshield or where the plate normally goes?

    Is it legal to drive on fake plates? No.

    Is it legal to charge somebody with the offense of possessing fake plates? Of course it is.

    Right, but what if the plates turn out to be legal according to the Texas Dmv? The license just didn't show up in the NYPD's system. The DMV was unable to be reached since it was a weekend and it is closed.

    So how does someone in NYC with no ties to Texas buy temporary Texas plates in NYC for a vehicle in NYC?

    You are obviously clueless.

    DMV database files are not closed on the weekends. The registration (not license) gets run through NCIC in order to access the DMV files in Texas. You seriously think someone calls DMV in Texas?


    If you have been charged with this crime you need an attorney. Only discuss your case with him. End of story.
