    Waht to Do if You Lose Your Wallet That Contains a Fake ID
    My question involves criminal law for the state of: New York.

    I am 19 years old. I lost a wallet with my school ID, fake forged ID (with my picture and name), and Driver's License in it. I'm not sure where I lost it, but I cannot find it anywhere, and it's been gone for nearly a week. I'm positive it isn't in my house.

    I'd like to contact my college's lost and found, but it is orchestrated In the same building as the campus police. I'm not sure what my course of action should be here. Should I contact the lost and found? Will the lost and found contact me? Should I just apply for new cards and ID's and hope nobody ever gets a hold of it? In the event I am questioned on it, what should I say/do? I plan on just denying everything. Nobody should be able to prove that I owned the fake ID, there is always the possibility that someone could have had it made and turned it in, one that I'm not sure can be proved wrong.

    I'm not sure what I should do. Any help is much appreciated. Thank you.

    The NY statute that covers this sort if thing is the PL 170.20 (and following sections) on possession of forged documents. This requires them to show intent to deceive someone with the document. Merely finding a fake id in your possession isn't sufficient. They'd need to see you try to buy liquor or gain entry to a bar or otherwise use the forged document.

    If the lost and found or the cops or anybody else finds your wallet, it makes any difference if you told them you lost it or not.

    Allow me to add that the fake drivers license is one of Pennsylvania.

    Unless your wallet shows up in Pennsylvania, that won't matter.

    We have gone with charges for Criminal Possession of a Forged Instrument (Class D felony) for mere possession of a fake driver's license. Assistant District Attorney's have no trouble dealing with intent to deceive/defraud when it comes to mere possession of this type of instrument. I have seen folks convicted in these cases.

    At the very least you’ll be charged with violating Section 509(6) of New York’s Vehicle and Traffic Law. This section makes it illegal (but not ‘criminal’) to “possess or use any forged, fictitious or illegally obtained license, or use any license belonging to another person.” You can be fined up to $300 (plus a $93 surcharge) and the law would allow the judge to sentence you to 15 days in the county jail as well.

    That's the surcharge in town and village courts. In city courts it's a very reasonable $88. :friendly_wink:
