Public Intoxication in South Bend
I am 20 years old and got a P.I. in South Bend IN on St Patricks day while waiting in line for a concert. I did not get a minor consumpt charge though. I have been arrested once before (minor consumpt) also in Indiana but it got "Deferred" and this was almost 2 years ago. I was just wondering if anyone knows what kind of legal hassles im in for. Classes and a fine I assume. Some people I talked with said they could suspend my drivers license. I was on the sidewalk no where near my car. Is this true? Ive already spent 18 hours in the drunk tank. Does that count as time served? What am I lookin at here?

what do you mean "cop to an MIP?" I was just thinking plea "no contest" and take what the judge gives me. What do you think my chances of actually going to jail are? I mean Notre Dame is right there. I would think they give out PI charges weekly.

A: If any of us on this forum could answer questions like that, we would be at the casino in between visiting our mansion in the Bahamas.:D

but the ND kids have money. Did you see Sunday's Trib and all the condo's and such that are going to be built around ND? The kid on the front page of that section was living in a $400k (I think) home that dad bought as an investment. A lot better than a dorm room.
Anyway; "copping to MIP".
What I was meaning was to possibly plead to the lesser charge of MIP (minor consumption)(plea bargain). The penalties are half what PI penalties are. I think the prior may come back to haunt you. A deferred adjudication is kind of a "get out of jail free" card and you used yours.
If you can afford an attorney, I would definately get one. If you can't afford one, I would seek a public defender, if possible.
