    My question involves criminal law for the state of: Texas

    Hi, I am currently on Probation for a non drug related charged. I'm on random drug testing due to the fact that I came up positive for THC during my probation assessment to go on probation. The random was supposed to last 3 months but since I missed a few days on accident by forgetting to call, my PO is putting me into an outpatient program. My question: Is he allowed to keep making me do random tests when I'm in the 6 week program?

    i don't know the specific rules of your area but anywhere I'm familiar with random drug testing is always possible the entire period of your probation. On top of that you screwed up by forgetting to call. I suspect your po sees that as you trying to dodge a random drop likely because it would have come back dirty.

    Feel blessed all that has happened is you are in an outpatient rehab program. S/he could always violate you for failing to comply with the rules.

    Of course he is. Why wouldn't he be? You tested positive for drugs. Then you missed a few drug tests. It doesn't matter what your excuse is you missed testing. If I was the PO I would suspect you're using and probably do the same thing. Even if you're in a treatment program doesn't mean you can't use. People find ways to get drugs all the time - and it's outpatient.
