Desperate To Get Out
i am 17 years old living with my mother, a brother who drinks a bit to much and physically abusive to all around him when he is unstable and my mother does nothing to stop him .my mother is physically and mentally abusive to me when ever she has had a bad day and that seems to be every day. .i seriously need to get out of this house.between my brothers late night partying and the stress i have to put up with from this environment i physically cant stand to be here.all the stress i have to put up with is making me fail in school.my mother takes all my money when i get paid .even though she has a job she takes my money to fix the things that she messes up have been forced to grow up really fast because of my parents,and now i feel that i am more than able to get my own place.i feel very confedent and have plans and have been lookin for an affordible apartment.
since i will be 18 in a 5 months would that make it easer to be emancipated??
what are the steps in emancipation?so because of my mother and my brother is there a way out? is there a way without her permisson?

Your best bet is wait the 5 mos your state has no satute for emancipation

Indiana has no emancipation statute, but it may nonetheless be possible to convince a juvenile court to grant emancipation where the court finds:
1. The petitioning minor wishes to be free from parental control and protection and no longer requires control and protection;
2. The petitioning minor understands the consequences of being free from parental control and protection
3. The petitioning minor has sufficient money for the child's own support; and
4. The petitioning minor has an acceptable plan for independent living.

but there is an officer at my school where i go that will back me up on every word i say.he is the one who told me to try to get emancipated.so if he is on my side do u think that would at all matter?

right i understand that.so would u happem to know what the steps are.cause my mom will freak out and never let me leave the house.EVER.she already done all bad things possible to hurt me.so how could i get a judge to reason with me?

There are no steps because there is no statute

i got all that but its alot harder to explain typing.its way better to explain in person.i understand there in no statute.well how can i get the judge to be in my favor?

You petition court and plead your case. with no statute you will need to prove what the post states
1. The petitioning minor wishes to be free from parental control and protection and no longer requires control and protection;
2. The petitioning minor understands the consequences of being free from parental control and protection
3. The petitioning minor has sufficient money for the child's own support; and
4. The petitioning minor has an acceptable plan for independent living.
Can you at least prove these four points?
