    Question on custody orders for a 16yr old
    Question: a friend of mine in Southern CA finally got final orders from judge giving her primary custody of her 16 yr old daughter who has been living with Dad. The daughter does not want to live with her Mom. But the judge ordered immediate removal of the daughter from the father, because he is alienating her from her mother.
    He refuses to hand her over and says she does not want to go. They go back to court on an ex-parte hearing and the judge tells the Dad to turn her over with her belongings the next day at 10am at the police station where the Mom lives.
    That was today! He showed up with the daughter but the daughter refused to go. The cop stated to the Mom that he cannot physical touch the 16 yr old and put her in her Mom's car.

    Is that true? What is her recourse beside going back to court again (which she will next week) if her EX will not hand over the daughter and the daughter refuses to go?

    There's no good answer.

    Mom can keep pressing the issue, and may in fact get the judge to impose conditions on dad which make him give up trying to interfere with custody or from supporting the girl when she runs away. But the girl may end up having her relationship with her mother worsened by this process. The girl may keep on running away no matter what the court says or does.

    Sometimes it's best to ask for a family counselor to be appointed by the court, or selected by the mother with participation ordered by the court, to facilitate a transfer of custody and restoration of the parent-child relationship. You would want a really good counselor.
