Child Abuse Charges

I was charged with child abuse and need some good input. I spanked my gf's kid on the butt with a paddle. He has alot of problems with self control. I was using the corner as the start of discipline then that was not working so we went for exercises. He decided he needed and excuse to get out of it so told me he had to use the bathroom. I went with him to make sure he don't goto sleep while he is being punished otherwise he won't wake up tell the next day. He lied about having to use the bathroom so he was paddled with pants on the butt. Then was told to continue to do exercises tell I was satisfied he is done. (less than 5 min) Told me he had to use bathroom again so we went and he lied again.

He was then paddled with pants down to his knees. He was paddled and he anticipated the hit and ended up hitting the back of his legs. I told him he would have to get into proper position and do it again. So he got 5 or 6 total hits. (start of first lie and the second) The next day he had bruises on his ass and back of legs. The mother acknowleged that I need to be more careful. I stated I can't do that anymore and she would need to take control of him being out of control. He has problems 3 of the 5 days in school every week which are written from his teacher in his planner. He was being punished for hitting his head on the table at school with his head causing some redness.


He went to school and told the teacher he couldnt sit down. CPs came to school and took him to a DR that works for them! Dr stated bruises are consistant with child abuse. I was called by my GF and we got together and went to this office. I was placed under arrest after I refused to go further than telling them he making problems and was paddled and jumped out of the way and hit his legs.


They generated false statements and said that I just jumped up and started beating this child. These are some additional false statement's they have made.

1 This is not the first time this has happened.
2 Dad says shut up and bad words and asshole.


I am missing some paper work but have other statements from them about there investigation. They made it sound like I just beat the kid and used no other methods. The mother is against this CPS agency and is understanding of the whole situation. I already paid this attorney 5k cash upfront. He never returns calls and is always unavailable. I always have to wait for phone interview about 3 weeks away. In the begining this attorney told me it was only one time and no history of this abuse. He thought it would be dropped. The state wanted guilty plea and 6 months confiment. I started to see a mental health counselor because of all the stress. I had to live in a van at walmart parking lot for about a month. I was allowed to see kids with supervised visits only. The kids then went to chicago for spring break and were never returned.


Anyone have any expertise in this area? I took a adjudication withdraw but I was told it can only be sealed if anything not expunged! And get 2 years supervised probation. I do not believe the punishment fits any crime. I only paddled him on the butt they claim I gave him bruises on head and back and legs. I am only responsible for legs and butt! Thanks for your time. Jay, You said ths was your girfriends child...Is the child yours too? If not, is the father around? And how old is the boy?

I am not the father. The child is 7, his brother is 4. The 7 year old is the only one who has issues. The Cps is telling the mother I am never to return, they don't pay the bills or contribute to the family value. blah blah. They are dictating everything. How can they be stopped. They have no jurisdiction for any of there fascilitated actions. Sometimes I feel like using my military training and going on a mission and hunt them down and using techniques that will bring the truth and lies out of them!

There father abandoned the mother and kids and went to another state left them no food, money or car.

An simple "spanking" will not leave bruises this was abuse. Anyone saying otherwise is in denial!

I was not beaten as a child nor do I beat my children. If a LEGAL STRANGER attempted to "paddle" my kids I would shove the paddle down his throat! You and the "mother" of this boy both deserve prison. If he has these Neurological issues what you are doing is even MORE sick and vile! You are beating him like a dog for behavior he has very little or no control over. If the "mother" of this poor boy had, had a NEEDED Neuropsychological Evaluation done an education and behavior plan would have been issued and recommendations given. And I can GUARANTEE that the Child Psychologist would NOT have recommended "paddling" him till black and blue for negative behavior!! This kid has neurological problems, that does not make him a "bad" child. He CAN NOT control his outbursts, and it seem neither can you!

BTW...I have one daughter on her way to Vassar and another with PDD, both are lovely and well behaved girls that excell in school, and have never had sex in school! And all this without EVER having been assaulted by their parents!

Actually, I got frequent spankings....often with a belt, but I do not recall EVER having bruises of ANY kind! Also, only my parents ever spanked me. If I had doubts about whether your treatment of your girlfriend's child were beatings or just spankings.....your comment about using "military type" violence to "bring the truth" pretty much dissolved any benefit of the doubt I may have considered.

It seems pretty obvious to me that a child that suffers from the emotional issues you mention would not respond well to beatings by Mom's boyfriend. Leave the kids alone. You have NO right to discipline them at all.

It was not a big hit at all just a tap on the ass. Even the arresting officer felt this was something that could have been controlled without a serious issue of arrest. I contacted a friend of mine who is a federal agent and read him everything and agreed they wanted to hang me out to dry.

My military training is the only reason I didn't loose control. Had I just left the house to calm down and could have gotten in just as much trouble. The mother was not home. They CPS workers added false info to build a case otherwise it would of been a simple spanking causing bruises. Thats exactly what it says on police report. The officer agreed they were going over board but you can't do anything. Politics ruin your career as a police officer! Some of you may know what I am talking about!

Oh, but you DID lose control the moment you put a paddle to the boy. I agree with Bay that the boy has some emotional/behavioral issues that aren't being addressed properly by "excessive corporal punishment". You can also use some pointers on effective parenting and anger management.
