What Can You Do if You Think Your Spouse Married You for Citizenship
Three weeks after my Ecuadorian husband received his citizenship he ask for a divorce. Since he has apparently used me to get his citizenship, do I have any recourse.? We have a 3 year old child he is asking for custody of so he won't have to pay child support. Not that he will get it but this is his mentality. I left my family and friends to move to CA with him and have no one but him here. I can't even go home to my mom and dad or I have to give him custody of our baby. I have a disability and can not take care of myself and our child without help from my family but they are a 4 hour plane ride away. Thank you in advance for any help you can offer me.

Its not at all guaranteed that you cannot relocate with your child. If you have been the primary caregiver for the child and you cannot financially manage without family assistance you would have at least a chance of being able to relocate. Could your family help you get an attorney? The one thing that you must do is stop listening to your soon to be ex husband about how the law works.

Thank you for your reply. I am going to ask my family for help hiring a lawyer. I will assume there is nothing I can do about the citizenship issues since it wasn't addressed. From what I've read on here in other posts, I will be responsible for travel expenses for the baby's visitation if I choose to go back home and that's probably not going to be an option for me. But thank you again for responding.

His citizenship is irrelevant.
I'm asking this for the sake of clarity, okay? What makes you say that he wouldn't get custody?

I'm assuming we will have joint custody. I have been the main caregiver for our son and worked part time from home, when the baby is sleeping. There's really no reason he would get anything more than joint custody. Unless you know something I don't ??

I was curious as to why you seemed to think that the court wouldn't award him custody, if it was decided that the child would be better off staying in CA. That's all.
