Being a sex offender does not forbid you from marriage. Far as conditions they vary by case and State

I'm just saying my fiance is about to get out of prison and I have a 3 month old child and I want to make sure he can be around my child or if we have to be married for him to be able to be around my child?

A bigger question is why would you want him near this child? If anything happens to this child at his hands you could be charged as well since you have knowledge of his crime(s) and still married him and placed your child in danger!

You will need to check the conditions of his parole. Depending on his offense he may be restricted from being around children and if you allow him to live in the same house as your daughter you run the risk of losing custody of her as well as criminal charges yourself.

Is the "Offender" the father of the child?

If the sex offender gets out of prison and has to go to court ordered sex offender counseling he will not be able to be around any children for a certain amount of time as the counselor and his probation/parole officer will allow. He will be able to earn time with you and your child but under no circumstances will he be allowed unsupervised visits with a minor child. Most likely he will not be able to live with you in your house while on probation. But most of this will be up to the judge and may depend upon what the conditions of his release are. If he doesn't have any conditions on his release then it would be up to you. But you should realize that you may not be the best judge of character here because you are a little to close to the problem to be able to see it clearly. Think long and hard before you allow an untreated sex offender access to your children.

P.S. You cannot void any conditions he may or may not have on his release by getting married. Whatever his release papers say is what he will have to do or he will just go back to prison.

Do not presume what the terms and conditions of parole would be. There are a wide range of sex offenses, and the terms and conditions of parole can be significantly different for any given offender.
