    Can a Tenant Avoid Paying for Carpet Cleaning Based on the Age of the Carpet
    My question involves landlord-tenant law in the State of: Pennsylvania
    After many issues, many neon signs have been put in front of us to move. We have lived in this townhouse for 12 1/2 years. I'm curious where we would stand with my security deposit. The property manager said to have the carpets cleaned before we leave. These carpets are 13 years old. There is no way they are going to rent to a new tenant with the same carpeting. I know they will rip them up and replace them anyhow, so what is the point? I'm just wasting money. I know I should do it to get my deposit back but if I don't they will deduct the cleaning amount so I'd save myself the hassle. Then, if they want to charge me the cost of replacing can't I argue the life of the carpet has gone well beyond the expectancy? I don't want to be a jerk but this is a property manager who would not fix a faucet that is running so badly when turned off that you have to shut the water off under the sink. The rest of the place is in perfectly fine shape. A few holes from nails that we will patch but nothing crazy. Thank you for any suggestions.

    What does your lease say about carpet cleaning, and fees that you might have to pay if you don't fulfill your agreed duty to clean the carpet upon moving out?

    What did the property manager say when you suggested skipping the carpet cleaning based upon your belief that they would replace the carpet?

    Yes, you can defend against the carpet cost due to depreciation but, chances are, you will have to sue in small claims court to get your deposit back anyway.

    It would likely be less expensive for you to simply clean the carpets.
