How to End Guardianship With Family After CPS Intervention

My question involves a child custody case from the State of: Wisconsin.

i set up gaurdianship aftet 6mos of cps removing my children from my home (i was living with my father mind you) my aunt took gaurdianship of my 7yr old and my father of my 6 yr old. I was accused of smoking weed in front of someone elses child while mine were in school. i passed every drug test in the 6mos. moved out on my own since the cps worker said my fathers home was not good enough. my children stay with my grandmother. i get my 6yr old every weekend, and have to fight for a few hours with my other son, he isn't allowed to spend the night ever. I am still in active counseling and drug rehab therapy. my aunts act like i have no rights and I just want my kids home, i call EVERY night. I have a great home always have food. still take drug tests, i dont know what i can do to being my children home. the order of gaurdianship was established in august of 2015.

Unfortunately, once the SYSTEM takes your children from you, you have no rights until a judge says you do.

If you want your children back any time soon you are going to have to hire a lawyer to petition the court to order the return of your children.

If you aren't prepared to do that, the SYSTEM will keep your children away from you until you are.

the SYSTEM didn't set gaurdianship, I did. even tho my children stay with my grandma i granted gaurdianship as i was looking at a prison sentence. my dad n i filled out the papers n filed them. I am wondering what rights i do have if any in regards as to my son staying on the weekend and what i would need to file as i already did everything CPS asked of me rather blackmailed me into signing this agreement to proove my innocence. now that I have no jail/ no probation. we want our kids home.

OK, so you voluntarily signed the guardianship papers in the belief that CPS had the power to put you in prison? How is that not the SYSTEM?

Anyway, no need to belabor that point.

Was any court involved in the guardianship? If the guardianship was not court-ordered then I don't see why you can't just revoke the voluntary guardianship and get your children back.

Bottom line, though, you are still going to need an attorney to get even that done right.

The relevance of where their fathers are at is because if the father(s) established paternity they have rights too. Did they establish their paternity and/or have child support orders?

If your six months is up that you set up then go get them. Did it get extended? Go talk to a lawyer - most give free consultations.

This is simple: Get a lawyer or don't get your kids back. It's not us that you have to convince.

I do. but they don't care.

thanks for being dicks about it. i was simply asking what i could do. i cant afford a lawyer or i wouldn't have asked the site. I thought my family wouldn't do this, but obviously I was wrong. I simply wanted to know what form or process or even what my rights to visits were. I am not convincing anyone just trying to make sure that whomever could be helpful knew the whole story.:wallbang:
