What Happens if You Divorce Before You Have Citizenship
My husband and I are married in good faith. We live together with his mom. The apartment is rented under her name. We have the joint bank account, photos and billing statements. Couple months before my 2 years green card gets expired, I figured out my husband has been cheating on me and his girlfriend gave birth to his child. My husband wants to divorce with me so that he can make birth certificate for his child. I tried to convince him to come back to me. I desperate to be with him but he loves his newborn child more than he loves me. He then moved out to live with his girlfriend and his child. My mother in law and I do not get along with each other because we have way too many differences that we cannot resolve. She wants to cut the rent and moves in with my husband in his new place. With them both leaving me, i have a broken heart and deep sadness that i don't know how to get over it.

I have a stable job to pay for my bills but it won't last for long if i have no roommates to share the bills. I have been so stressed to the point that recently i often experiencing forgetting things, losing my self control, getting angry easily and keep talking to myself without realizing it. I am so scared. My husband said he would not sign to help me get the 10 years green card because he does not love me anymore and he doesn't want me to stay in the US.

I lost my husband. I cannot lose my job. I cannot lose my future. Please tell me how to obtain the 10 years green card and the citizenship. How do i prove that i will have hardship if i divorce him? My family are not living in the US except my sister; and my sister just recently got a divorce too and her income cannot support me. We live in different states. How much does the legal fee cost if the divorce happens?

You will need to request a waiver of the joint filing requirement. See the instructions for USCIS Form Form I-751.
