Store only prosecutes they dont decide how its prosecuted. You dont have to be fingerprinted to be arrested. A simple citation (notice to appear) wiull suffice so yes itws very likely you were arrested! You questions about diversion etc should be asked of your Attorney

I really cannot have this on my record!!!

shouldn;t you have thought about that BEFORE you stole something?

If you are this worried, hire an attorney to talk to and try to see if they are going to prosecute you.

Realistically, you should simply settle down and wait to see it you are going to be charged. Until you are charged, there is nothing you can do except research and understand the laws involved.

I know that I made a mistake .. I make a very big mistake and I am not blaming anyone else for my own personal actions. I am the type of person who will take responsibility for those actions.

I appreciate any help I can recieve.

How much does a decent lawyer cost...I know they differ from place to place but what is the average ... I don't have extra money.

Are the court appointed lawyers any good. I really just don't have extra cash for that...I mean I could maybe do some type of payment plan but I can't have it up front.

My take on using a court-appointed lawyer versus a retained lawyer.

If you read Aaron's link you will see that the Judge looks at your income before your awarded a Public defender. What you say you can afford and what courts say may differ.

Thanks for the information on the lawyers. If anyone knows about a defered sentence or some type of alternate program it would be helpful to also know.

Since I haven't ever been in any type of trouble am I able to do something like that?? I am 19 years old.

Diversion programs vary by State. Suffice it to say if you meet conditions of diversion program you will not have a conviction on your record

Am I allowed to call the store and talk to someone to find out if they are going to press charges ... or should I just wait and see whats going to happen?

I just don't want to call and have them change their minds just because I was wondering.

    Any other suggestions???
