In MO, what is a plea of 12 years state stand silent?:confused:

That means the defense attorney will ask for a sentence of 12 years and the prosecutor has agreed to say nothing.

But be aware that does not mean that the judge has to accept the plea, But most do.

The prosecutor did speak and lied when he did. It pissed the judge off and he was given the full 12 years. Is there anything we can do about that? Is that wrong?

I'm not sure that there was a violation of the agreement, unless the prosecutor advocated for a sentence. The defendant can discuss the terms of the plea agreement with his defense lawyer. Also, he can discuss the prosecutor's conduct and whether it would provide for any relief from the sentence. However, you seem to be stating that the sentence given was the one bargained for, so it's hard to see how the defendant was prejudiced.

the prosecutor agreed to stand silent and he didn't hold up to that part of the bargain. the judge even told my fiancee to appeal the sentence.

the prosecutor was supposed to stand silent and he didn't hold up his part of the bargain because he did speak. and I'm the defendant's fiancee, it was statutory rape. he had no other background of problems with the law and they gave him 12 years, that doesn't seem right to me because murders dont even get 12 years!!!!!!!

Does any one know of any good lawyers that could possibly help with this, that isn't to expensive?

How old was the victim and how old is your fiancé?

she was 14 and he was 18 she is now 17 and he is 22. she waited 2 years before pressing charges. there's a whole lot more to this case but i'm not gonna go there because everyones opinion is different.

So, maybe he should have killed her to get a lighter sentence? EEEK!!!!

Sometimes the sentences that are handed out don't really make much sense. Your local area most likely has a legal aid society or the equivalent and they should be able to help you to find an attorney.
