Can You Break a Lease if You Don't Have Working Heat in the Winter
I live in Iowa and it is winter (some days have been highs of 15). I have been 20 days without heat in my apartment. My landlord made me aware of the problems and all correspondence have said it will be fixed in a couple days, that has now turned into 20 day with no end in sight. She said the part came in 4 days ago but I have yet to see any workers and still no heat. I am 2 months into a 6 month lease. My landlord furnishes all utilities. She has supplied me with a space heater that she enters my apartment (whole other side issue) and turns off during the day. What are my rights? Can I terminate my lease? Would that mean forfeiting my deposit? Please help!
Re: Midwest, No Heat 20 Days and Counting Can I Legally Break My Lease
Read the following sections of the Iowa landlord tenant statute:
Landlord to maintain fit premises.
Noncompliance by the landlord - in general.
Wrongful failure to supply heat, water, hot water or essential services.
Tenant's remedies for landlord's unlawful ouster, exclusion, or diminution of service.
Should be something in there that would help you.
