    Emancipation Situation for a 17-Year-Old in Texas
    Ok heres the situation in question. I've done some reading on the Emancipation here and other places. I understand the 17, the living apart, and self-sufficient or whatever that last word was. I've also read that in certain cases where it is deemed that it is better for certain reasons for emancipation to be granted for either the parent, the child, or a child of the child, these special cases also allow for it. I want to question if this situation would be regarded as one of these.

    Situation is, I'm 19, my girlfriend is 17, to be 18 in December. Last summer he kicked her out at 16 and left her to figure out her own life. Well after a while she had no other friends to stay with and no family would help her. So I rode her around lookin for places to stay whenever I could. But since I was due for college, my parents had to take the situation into their hands. They called her father and he said just hand her over to the police, he wanted nothing to do with her. So CPS took her, he declared her as a runaway, left her there for a month in "bootcamp" and took her out in September. In November he told her he was taking her to London, but left her in Africa and taunted her by saying "Get your boyfriend to help you" but he wanted nothing to do with her. Well I did, and brought her back to the States. I've handled her up til now but now its difficult to find a place for her to stay. If she was emancipated we could sign her into job corps and she'd be alright, because he wont sign to get her in. Even though she is not self-sustaining, if she could state that she had a sure-fire road of support AFTER being granted emancipation because the father won't help her to help herself, but he wont house her either, would it be grantd better suited to be given her emancipation? I also hear if she files and he doesn't respond to the hearing, she'll win by default. Is this true also?

    This is a CPS case not an emacipation case!

    Yea but we went through CPS once before and it solved nothing. So now if she could file for emancipaion, would the fact of the father not helping and the fact that she could sustain herself once GRANTED emancipation, would that make her eligible?

    You state that she can not support herself.

    That is one of the requirements that would need to be proven.

    He has abonned her twice! she has a case tell her to keep filing complaints

    Yea I say though I've read other documents and results of past cases and there are SPECIAL cases where other factors influence of emancipation. If ofcourse it proves in the best interest of the petitioner or respondant. Does anyone know anything about the special cases? And plus again, would she win by default if he does not respond?

    "Special cases" by their very definition are "special" do not use these as examples!

    Emancipation decisions are based on facts! Not "What ifs"

    These are the requirements:

    Quote:

    § 31.001. Requirements.

    (a) A minor may petition to have the disabilities of minority removed for limited or general purposes if the minor is:

    (1) a resident of this state;

    (2) 17 years of age, or at least 16 years of age and living separate and apart from the minor's parents, managing conservator, or guardian; and

    (3) self-supporting and managing the minor's own financial affairs.
    She does not meet them.

    CPS will help her.
