Suspected of Drug Trafficking After Staying With Dealers
    Florida...Sarasota County

Last Feb. my husband was staying a this brother's house for a couple days with another guy. The two guys were drug dealers and always had stuff in the house. One morning the house was raided while my husband and two other people were there.
They got a warrant from two trash pulls where they found baggies of residue and a tip that there was drug activity. Supposedly they watched the house one day and saw nine cars come an go.This was their grounds for a warrant!
They found a lot of drugs in the house. The thing is they only arrested my husband and gave him a trafficing charge, manufacturing, and a possesion charge. They claim that he admitted that the drugs were his and that's why they arrested only him but they have it nowhere in writing or tape or anything. There was absolutely nothing tying him to that house or the drugs. Now almost a year later we're still fighting it and the only evidence they have is a baggie of residue with his partial print on it. We go to court on Tuesday. We have a lawyer. Should we worry?

Worry about his being convicted? Yes.

Well i don't see how they can have solid case against him. There is resonable doubt all over it. He didn't live there. No one ever saw him there. There is no kind of proof that he was there except for a single fingerprint on a baggie of residue. Two other people were there that day that he was arrested and the only reason that they took him in was because they say that he claimed it all as his. That's hearsay isn't it? They have nothing else on him except for that. Also we went to a motion hearing the other say and the arresting detective said that before they busted into the house they had never even heard of my husband. They were expecting to find his brother.

    Explanation 1: He was using.

    Explanation 2: He was dealing.
Explanation 2a: He was dealing in order to pay for the stuff he was using.

Explanation 3: Maybe belangesamantha can help us out?

I answered every question that was asked. I only got nasty when people were patronizing me for their own amusement.

To be honest I have no idea how his fingerprint got there. He never dealt drugs. He never did drugs.

He was just in the wrong place with the wrong people.

I understand that to each their own opinion. That's your choice. I don't appreciate however comments that serve no purpose but the patronize.

I came here to get help. Any question that someone asks to get me that help is more than welcome and I will gladly answer it.

He was either dealing or doing...How else would his finger print get there??? This is not about being nasty...but you need to wake up and realize that your husband is most likely doing drugs ...That doesn't mean you have to leave him...but you really need to be aware of what is going on.

If you think we are "patronizing" how do you think the prosecuting attorney will be? Get some thicker skin or leave this to the attorney to figure out...

I understand that it looks bad but i know that my husband doesn't do drugs. That's how his best friend died and he gets really defensive about doing them. He says that his brother went to do drugs one night and that he took them from him. I don't really know what exactly happened. We both know that he shouldn't have been where he was but the way he thinks ofit and i understand is that no matter what his brother was doing was on his brother.

    UPDATE!!!

So we were reading through the deposition from the detective that got the warrant. The detective said in almost 3 different palces that he did a trash pull on the 3rd and the 14th of Febraury 06. The only problem with that is that the 14th is a tuesday and trash only comes on Fridays where we live.

Is this a good thing that we caught it?
