Why Would Continuous Family Violence Charges be Filed for a First Offense
A woman called the police about being abused by her boyfriend, the first time the police were called to their home, and he ended up charged with a felony for continuous family violence. Why would he be charged with that very serious crime rather than with a misdemeanor, if he has no D.V. priors?

The most reasonable guess would be that when the victim reported his act of domestic violence to the police, she described at least two incidents during the prior twelve months in which he injured her through an act of domestic violence, such that the police charged the continuing domestic violence offense, a third degree felony. It is not necessary that the prior incidents have been reported to the police at the time that they occurred.
