    Felony Petty Theft in California
    I was recently arrested and charged with petty theft w/a prior (at Mervyn's). In CA this is an automatic felony, even if the prior is another misd. petty theft. This seems unfair, shouldn't they take each case's circumstances into consideration before giving that person a permanant "X" (strike). I am now looking at prison for my STUPID mistake. This cannot be happening. I've realized that I have a problem and am seeking help, including a theft alternative course. I am a mother of 3 and can honestly say that I am sorry for what I've done, not for getting caught. Are there any jail alternatives?

    I'm sorry. I was under the impression this was going to be a helpful website. I know what I did was wrong and I've had a serious wake-up call, believe it or not. I just needed some helpful advice of where I go from here.

    (There are some people here who react negatively to self-pity.)

    You need to get a good lawyer and try to negotiate a plea to a reduced charge.

    Petty Theft the second time around is pretty much a given that it will be a Felony. I had an officer tell me once that it's sort of the courts way of letting you know that you WILL listen this second time. You're giving mixed messages too, you are sorry for what you did but not for getting caught. The counseling will help, but you need a lawyer.

    (ps....I wouldn't let the judge hear you say your sorry but not the caught thing.)

    O come on Senior Judge - please! Your not paying higher prices because of shoplifters . The mark up in retail does not factor in theft that much. Thats why stores are allowed to access a civil penalty to get their cost back. Now as far a second time a felony goes, a good attorney can work to get the felony reduced. As far as jail time, not hardly in California. The state , CA,is now releasing,way early people in jail that have commited and are serving time for minor felonys because of overcrowding.

    Fish speak when you know what your talking about please. The Civil fine pays for Loss Prevention, paperwork to name two things

    I'm thinking it's kinda ironic that I 'chime' in with a post that pretty much echoes the sentiments of responses by SJ and Mr. K the other day and that post is deleted, presumably by the moderator.

    Hey, it's his forum, he wants to play faves.....so be it!!!


    And my (deleted) post was not all that particularly cynical, nor mean-spirited, anyway.
