Is a Tourist's Child, Born in the U.S., a United States Citizen
A U.S. citizen is dating a foreign national, who is presently six months pregnant. If she is in the U.S. on a tourist visa when her child is born, will her child become a U.S. citizen?

Any child born within the U.S. borders is automatically a U.S. citizen.

If the long-term plan is to marry and have the mother move to the U.S. and to try to become a permanent resident, the couple may want to discuss their plans with an immigration lawyer. Merely having a child in the U.S. will not make her eligible for permanent residency or citizenship.
