IF a capias is withdrawn, does that mean the warrant is now void?
Q: IF a capias is withdrawn, does that mean the warrant is now void?
A: It means that that warrant is void; it does not mean the charge has been dismissed.
Ok,
let me explain this a bit...
when I was in trouble it was 1987 for burglary.
I did my time and was on parole.
I paid my restitution and my parole ended.
upon investingation into my court dockets last week,
(I was looking into it to find out about getting an order so that Ican take my son hunting this year his first year)
it shows where there was a capias on me for being in contemt of court for not showing up at a hear for my fines and restitution. (which is paid)(this was in 2000 and I haven't been on parole for 10 years!)
first of all how can I be in contempt of court for something I knew nothing about? Next thing is how can they say that I still owe them all this money when it is paid?
then I saw a paper that was filed saying the capias was withdrawn and case closed, what does all that mean? if the case is closed can it get reopened?
I am in Pennsylvania.
Who or where can I go to find out about all this and not worry about getting arrested or something?
Now maybe I can get a bit better answer?
