How to Seek Custody When You Have a Child Support Warrant
My question involves a child custody case from the State of: New York
I'm posting on behalf of a good friend of mine who resides in Florida..
He received a piece of mail stating he is able to file for custody of his kids in New York.The mother of this kids are facing jail time at the moment and now the kids' grandmother is trying to file for custody. He currently has an active warrant for child support and he is worried that they will arrest him and throw him in jail if he goes up there to obtain custody. He currently has a stable job and paying child support and arrears. He also has a stable home and is able to provide the needs for his kids. What are the options available for him in this kind of situation? DO you think they would grant him custody because the mother isn't fit and the grandmother isn't the parent?

They can, yes. Whether or not they will depends on facts we don't have.
He should speak to an attorney, specially if he hasn't seen them for an extended period.

Just out of curiosity, is there anything they CAN do with the warrants PRIOR to going up to NY and obtaining custody?

Your friend needs to come on here and post since they have all the facts.
Yes they will probably arrest him if the police find out he has a warrant. And then he goes in front of the judge, says how he is going to purge himself and go from there.
He needs a lawyer. ASAP.
