Can a Temporary Guardian of a Minor Relocate With the Child
My question involves a child custody case from the State of: Montana. My mother has a temporary guardianship form that I signed a year ago (never filed in court) that expired in October of 2016. Is she allowed to move out of state without my permission with my minor son? Or is there something I can do about it?
Re: Temporary Guardianship and Moving
Why haven't you gone to get your child?

To provide a bit more explanation, Ohiogal is pointing out that in the absence of a court order -- even if you signed a now-expired document that could have been used to obtain a court order -- you can end the current arrangement at any time that you choose.

No. Just go get your son. Why does she still have him? You didn't even file it with the court and it's expired so she has no guardianship anymore.
