Is it Illegal to Collect Child Support if the Child No Longer Lives With You
A woman kicked her fifteen-year-old daughter out of the house. The daughter is staying with an aunt. The aunt has asked that the mother pay her the child support that she receives from the child's father, but the mother refuses. Is it legal for her to keep the child support even though she is not actually taking care of the child, in New York?

Yes, it is legal to accept child support even if you are not caring for a child. The other parent, the one who is paying child support, may bring a motion to modify child support based upon the changed circumstances.
If the aunt seeks guardianship of the child, she can seek child support through the guardianship court.
