Will Disorderly Conduct Show Up on a Criminal Background Check
    Hello,

My question involves criminal law for the state of: New York

If one had an Arraignment of charges: (over 2 years ago)

    240.20 - Disorderly Conduct
    155.25 - Petty Larceny
    165.40 - Stolen Property

Court Action = Pleaded guilty to 240.20 Disorderly Conduct.

Im getting hired as a banker, and they require me to go to the station and get my finger prints done as part of the criminal check. Will 240.20 show up? since its not technically a crime and over 2 years. How detailed the report might be? Will it include the original complaint that was made about me and the other 2 charges? Or might I simple be asked to explain what happened to HR and hope for the best? And lastly is there a time period when this might not show up on a back round check like after 5-10 years?

    Thank you!

If the police agency is the one that processed the disorderly conduct charge, then the record may show up even though it might not show up on a search performed elsewhere in the state.

A criminal history normally shows the original charge and the disposition.

It's up to the prospective employer to decide whether to give you an opportunity to explain your criminal history.
