    During a divorce in New York, if you move out of the marital home, are you required to continue to pay for homeowner's insurance? Does that requirement apply even if you are paying child support?

    You need to start by checking the court orders for your case -- there may be a status quo order that relates to the payment of expenses, including insurance, while the divorce is pending. Also, even if there is not, it would not make sense to let the insurance lapse on what is often the largest asset (and largest liability) in the marriage. Further, if you don't make the insurance payment and your spouse has not agreed to bear the cost, the issue is likely to end up before the court.

    Your best bet is to work with a divorce lawyer, and to have your lawyer assist with the division of financial responsibilities while the divorce is pending.
