    Choose your words wisely. Planning generally is a bad word unless it is referrrknf to something like complying with every last rule of your probation.

    . Something more like: I intend on traveling to India....when my probation ends, whether it be at the originally designated time or earlier should the court see something in me that would allow them to consider terminating it before
    thst time.

    After I go through the whole process of speaking to my probation officer. If I have to say it writing than I will. Seeing that once I hire an attorney I am deeming myself unfit to represent mylself in a courtroom.

    No, you aren't. A judge understands the purpose of a defense lawyer and it does nothing to diminish you in using one.

    technically I'm hiring an attorney because I can't represent myself because i don't know how to.

    As I said you need to file a motion to get this in front of a judge. I doubt very much you have the skill or expertise to write such a motion.

    Considering the importance this issue has to you I really think you need legal representation.

    I think he said he intends on hiring an attorney in the post just before yours.


    I am curious. Given you are in NY, highwayman, I'm guessing you know how things work. Is the probationer filing a motion the only way to get this done? I know in my area the probation officer can and has actually taken issues like this to the judge themselves. Obvioisly they won't do that unless they agree with the request. Then, with no hearing or anything actually, either the judge agrees and signs the ordered the po has prepared or he denies the request.

    While a person can hire an attorney and file a motion directly, your po actually presenting it to the judge is a real possibility as well.

    And you don't know how to. You may think you do, but there's a reason attorneys go to law school for three or four years to learn how to. Watching Law and Order re-runs is not a substitute.

    Are you sure that India will let you travel to that country with a conviction here in the states? You might want to look into that aspect of your situation before you spend money on a lawyer to try and get your probation shortened if you can't do what you wanted to even if you get the probation ended early.
