How to Get a Divorce if You Live in Different States
A married couple in Virginia separated many years ago, and now live in different states. They agree to get divorced, and there are no issues to resolve other than the divorce itself (no kids, no property to divide). How do they get a divorce if they live in different states?
Re: How to Get a Divorce if You Live in Different States
Either spouse can file for divorce in their state and county of residence, as long as they meet the legal residency requirements. One spouse will file for divorce where he or she lives, then have the other spouse served with the divorce -- or the other spouse can voluntarily sign and return an acknowledgment of service with no need to pay a process server. They can then proceed with a divorce -- and they should be able to proceed without a lawyer.
