17 Year Old Caught with Percocet
My question involves criminal law for the state of: Maryland
I am 17 and about a week ago got caught by police with about 4 pills of percocet and didn't get a citation or any piece of paper from police. The officer said I will be receiving a court date in the mail. They took my phone as "evidence" and said I'd get it back after court. Is it likely I will even have to go to court? Will I get charged? Probation? Do I need a lawyer? I did not get arrested and this is my first offense.

You can rest assured you are going to court. Possession of a controlled dangerous substance other than marijuana is a serious crime in Maryland. You should be research lawyers and not speak to anybody without your lawyer present.

What "evidence" was there on your phone and how did they know this evidence was on your phone?

You better get a lawyer.

As you're seventeen, and will thus ordinarily be prosecuted as a juvenile in your state, I suggest that you read up on juvenile court.

Police typically don't come into contact with someone, take their drugs and cellphone without filing some type of charges and giving them some type of paperwork. And in your case, the police would have had to call an adult to release you to.
Again, were these plainclothes or uniformed police officers?

They were uniformed, and they didn't take me anywhere they left me where they found me.

Then why did they take your cellphone? If they were plainclothes, I would of suspected that you were robbed, but you weren't.

I would suggest calling your cell service provider and report your cell phone stolen.

they took my phone because it had the drug on it crushed up

It might be time to discuss this with your parents.
They should call the police dept and verify that there was indeed an encounter with you.
You will need an attorney. Discuss the case with nobody but your parents and attorney.
Lastly...leave the drugs alone. Percocet is an opiate. Opiates are now killing more Americans than motor vehicle accidents.

Btw: in regards to your phone; after court doesn't mean after your FIRST court hearing. They mean, at best, at the conclusion of your court dealings. That means not until this issue is disposed of entirely
btw; you probably won't ever get the phone back, even after your case has been finalized.
