Immigration Issues From Divorce

My domestic partner and I are about to have a child and Im still in the process of divorcing my other wife.

We were married April 2005 and I petitioned her to get a permanent residency. I entered the marriage in good faith and I found out it wasnt for her so we got separated. Then I met my girlfriend and we were bless to have a child on july. I applied my divorce last January and it will be final on August. She is also an illegal alien.

My question is can my first wife drag me to continue with the removal of condition? because I really dont want to do anything with her or her status and she is still trying to get me to help her. Will USCIS question me and my soon to be wife when we get married even if we already have a child together? Is there a possibility that they might deny my petition for my soon to be wife. I love my fiancee and we are having a family and i dont want to be away from them.


Please help me. Anyone:(

If your then ex-wife attempts to maintain residency on the basis of the short-term marriage, it's a long shot for her to stay in the U.S.

If she claims domestic violence to try to take advantage of the immigration provisions of the VAWA, the USCIS will investigate the claim.

Your fiancée has a better chance of gaining lawful status, after marriage, if she originally entered the country legally.

She also threatens to do that. But she has no proof because I never touched her and she doesnt have any police report to back it up. She doesnt want me to divorce her and treats to tell immigration about my fiancee status here if i dont cooperate.

She wants me to still sign the papers and still goto the interview for her to have a premanent residency but I dont want to do it anymore. How can I withdraw my petition for her so it wont be a hassle in my future petition for my soon to be wife? PLease help. I do think this is harrasment now.:confused:

There's no mechanism to withdraw your petition. As previously indicated, you can choose not to participate in further proceedings.

If I go to a USCIS and talk to an immigration officer can I withdraw my petition there? And I just found out right now that she scheduled her sons interview in the philippines without my knowledge. Is there a way I can withdraw that petition too? I'm just afraid that it will trigger some denial on my petition for my fiancee. Thanks for the help again!:wallbang:
