Can I Get Emancipated if Living With a Relative
State: Minnesota
Right now I'm 16 and i have a job. My aunt has custody over, so she's pretty much my legal gaurdian. The problem is her and her husband emotionally abuses me conconstantly. And i can't go with my mom because she's mentally and physically unstable to care for me.
So i was wondering if i could get emancipated even if i dont live with my mom. Like my aunt (legal guardian) says if i want to leave i can because she has plans for when i go she will move with her family to Mexico. She completely OK's it for me to be on my own and to get emancipated. But we dont know the procedure to do so.
So what would me and her have to do in order to do so? Or is ther any other way?
Re: Can I Get Emancipated if Living With a Relative
There's no "pretty much" -- either a court has made your aunt your legal guardian, or she's simply a relative you live with by virtue of an arrangement made by your parents.
If your aunt is in fact your legal guardian and no longer wishes to serve, she needs to petition the court to discharge her.
If she is not your legal guardian and is no longer willing or able to care for you, it's up to your parents to decide where you live. Minnesota has no emancipation law, but you may be able to be deemed emancipated based upon your ability to self-support and your parents' permission to live independently. If you require others to support you, you're not a candidate for emancipation.
