Billed for Mortgage Payments After Completing a Chapter 13 Plan
A homeowner in New York declared Chapter 13 bankruptcy and surrendered his home to the lender. They required him to move out and took possession of the home. He recently completed his Chapter 13 repayment plan, and suddenly the lender is sending him demands for mortgage payments, and reporting nonpayment on his credit. His bankruptcy lawyer is not returning his messages. How can he get the lender to stop harassing him and stop placing negative information on his credit report?

Based upon the facts provided, it seems most likely that the creditor made a clerical error of some sort following its receipt of the order of discharge; but all we can do is guess. If the man's bankruptcy lawyer is not being helpful, he should consult another bankruptcy lawyer about his case, and the possibility of bringing a motion to hold the lender in contempt.
Before going back to court, perhaps the man can simply contact the creditor, provide a copy of the order of discharge, and ask them to explain their rationale for billing him. That may be enough to end the problem.
