    Is a Non-Custodial Parent Obligated to Pay for Driving Aids
    My question involves a child custody case from the State of: Illinois

    Is the non custodial parent obligated to pay for driving aids? Or does that is included in child support?

    As the non custodial parent, I do not feel I should be paying for driving's aid. I feel it is cover under my monthly child support.
    Please help.

    Are we talking about vehicle modifications (adaptive devices) that would allow a disabled child to drive a car?

    No, it is for a 15 year old taking driving lesson before driving license.

    So your child wants to take a driver's ed course, and you're wondering if you're obligated to pay for part of the cost? Read your custody order and see what it says about expenses and when they must be divided, according to whatever formula for division is described in the order.

    If there is nothing in the order that relates to expenses in the nature of driver's education, a custody court is likely to find that it is covered by child support -- but if the other parent takes the issue to court it might cost you more to defend against the motion than it would cost you to contribute to the cost of the course.

    So you think child support covers medical, daycare, and other such things too right? Do you or did you ever have to pay those separately?

    Here's what child support covers in Illinois: "A child support order in Illinois is in the form of a Uniform Order for Support. Child support payments cover the basic needs of the child such as food, clothing and shelter. Child support payments do not necessarily include expenses related to education, medical/dental costs, extracurricular activities or daycare."

    So you're wrong that the child support you send covers this. In Illinois child support covers basic needs and, unless specified, don't include other expenses. Other states might differ but not yours.

    What do you think you should do as the non custodial parent?

    More importantly why wouldn't you want your child to have driving lessons as required by law and get their license? Why wouldn't you want to participate in that?

    Why would you not want to help with driving lessons to help your child be a safer driver? Makes no sense.

    Eh, Mom can teach her, like I did.

    Why do you believe that driver's ed is not an extracurricular activity?

    Driver's ed classes usually result in a lower insurance rate for youngsters on your policy. Check with your state insurance.

    Why would you be opposed to this?

    It continues, "A court may order that the supporting parent pay additional amounts for these or other child related expenses." That's why we start by looking at the child support order.
