    How is Overtime Pay Calculated if You Work Seven Days Per Week
    An employee in California works every day of the week, often for fifteen days in a row, and at times for as much as thirty or sixty days in a row. The employee works four eight hour days, and shorter shifts on the other days. Sometimes the employee will work six or seven consecutive eight hour days. The employer says that overtime is calculated based upon a standard work week, not based upon how many hours you work over a given seven day period. Is that true, or should the employee get overtime for any hours worked over forty over the course of seven consecutive days?

    If your employer has defined a work week, for example, of midnight on Sunday through 11:59 PM on the following Saturday, overtime is calculated based upon hours worked in that week. It doesn't matter if the overtime hours would be calculated differently if the employer set different start and end times for the work week.
