    Can an Employer Change Your Job Duties Based on a Vague Job Description
    Can an employer in California assign an employee to perform tasks based upon a vague job description, even though the employee had a clear understanding when hired that those tasks would not be part of the job? Can the employee enforce the employer's oral promises?

    Unless there is a contract of employment that applies to the employment relationship (a contract entered into directly with the employee, or a union contract), the employer can change the employee's job description and job assignments at any time. With a contract of employment, it would be difficult to argue that tasks that could fall under the job description were excluded based upon a prior discussion. Further, even with a written contract, if the employee is an at-will employee the employer can still change the terms of employment.
