How can I legally evict my roommate in Chicago
Please help me with this:
I and my friend signed the lease, but my friend could not live in the appartment because he had to join his family. Therefore, I decided to look for another roommate to move-in.
This roommate did not sign lease but upon his arrival we agreed on few things including NOT to smoke in the appartment. I am allegic to cigarrate and I can't stand the smell of cigarrate smoke (sorry for those who smoke).
Anyway, I started suspect that this roommate was smoking in the house because I could smell it.. but he always denies. I eventually caught him once smoking in his room, and second time, and today is his third time get caught...His excuses..is it is cold outside. I have asked him to move out of the premise by the end of March!
Enough is enough, and I can't take it anymore. Please help me with proceduce on how to evict this roommate who is not on the lease. Do I have right to evict him? How many days do I need to give him?
Thanks

From what you say, you're the only one on the lease. That would normally mean that he's your tenant, and you would evict him as outlined on that page. Granted, there could be circumstances which would turn him into your landlord's tenant, but you haven't identified any. If that's the case, your landlord would have to evict him and you may be stuck for the duration.

My landlord doesn't know if he lives with me at all even though he might have seen. The lease holders are me and my friend who decided to leave for his family. When it comes to rent, this roommate gives me cash for his half and I write check for the whole appartment to the landlord. Does this give me right to evict him for what I have mentioned?

As he's your tenant, follow the instructions previously provided.
