Claiming That a Father Only Wants Custody to Avoid Child Support
My question involves a child custody case from the State of: FL
Tis the season for child support questions I guess. I had a thought provoking comment aimed my way by the mother. She claims that I only want custody (legal) to avoid paying child support. I almost laughed at that comment because I've had physical custody for such a long time.
My argument is that I've been caring for my son and didn't place any hard obligation (she did pay his school lunch bill monthly) on her. I had the help of my wife when it came to all bills so I didn't see a need to ask much more of her. We handled it.
Will her argument really float in court?

This is so common it's virtually expected in the courtroom.
It's a silly argument, and judges see right through it immediately.

Or the other way around. I suspect that in this dad's case it will be seen to be a silly argument. However, we do only have his side of the story, therefore we cannot be absolutely certain that it isn't the other way around.
OP, it is rather classic for a parent who has never had to pay child support, to turn around and file for primary custody when hit up with a child support order. It is also rather classic for it to be the opposite as well. Judges however, can normally tell quite well, which it is.

I can see that. Things haven't been going the way I hoped in my case and id just hate for silly arguments to prevent me from being seen in a fair light in court. I sought court prevention because of what she did and I want our son back home here, not to hurt her or deprive her of anything. And yes theres 3 sides to every story, my side, her side and the truth
