    Can Your Landlord Require That You Provide a Bank Account Number
    After three years in a rental property, a Colorado tenant has been told by the landlord's property management company that he must provide them with his bank account number. He has been told that if he does not provide that information he can be evicted. Is that true?

    Even if the lease agreement requires that the tenant provide a bank account number, it is unlikely that a court would deem the failure to provide the number as a material breach that would support eviction. If the requirement dates back to a three-year-old lease that has been renewed, as opposed to the most recent lease that creates a new requirement, the court would likely deem the requirement waived.

    However, if the tenant is a month-to-month tenant, or is coming up on the end of a lease term, the failure to provide the information could cause the landlord to choose not to renew the lease or to give notice ending the periodic tenancy, such that the tenant can be made to move without any cause beyond the fact that the tenancy has ended.

    If the tenant is concerned about giving bank account information to the landlord, the tenant can consider opening an account that is used for no purpose other than transactions with the landlord.
