How to Prevent Your Adult Child from Inviting Unwanted Guests Into Your Apartment
My question involves landlord-tenant law in the State of: California
In the past I had problems with my son bringing guest over and the cops told me that I couldn't remove them. I tried anyway; even after I posted here about my situation..... if my son bring his guest over at the new place how can I go about Removing them? Since my son is not on the lease if wanted to, can I put hIm out right away or do I have to go through a long process? Or do the landlord has to file the court paper work?

How about never letting the guest in, in the first place. Will your son still be living with you at the new place?

If your son lives there, he can have guests over. If you do not like your son's guests, don't let your son live with you.

Yes he will but he will not be on the lease so that should give me more power over him having guest over. Also if my son is not on the lease I should be able to kick him out of my house with ease. He will not be a co-tenant at my new place

He lives with me but he won't be.on the lease thus I should have more control over his guest?

The fact that he is not on the lease really won't help. Sure, it might make it easier to have him evicted, but, you might have to have your landlord evict him as you may not be permitted to. Plus, if your lease does not permit long term guests, you may find yourself in violation of the lease for allowing your son to stay.

Now, if your son sleeps on a couch and contributes nothing to the household, he could be considered a lodger and is subject to being booted out the door If, however, he has a room and/or contributes rent or in other significant way to the home, you may well find yourself having to treat him as a tenant.

The ONLY WAY to control his guests is to NOT allow him to live with you. As long as he resides there, he can have guests over and the police will do nothing at all to boot his guest.

So, if you want your son to live with you, you will have to deal with his friends.

    In your pm you asked:

if your son is not on the lease can you control who your son has as a guest; no

Again, if son is not on the lease, the how to remove your son if you so choose; you would have to evict him if he doesn't go willingly.
