My question involves criminal law for the state of Tennessee
I got pregnant at 17, around 3 weeks from before I turned 18. He's 24. Will he go to jail even if I'm over 18 when I have the baby?

Pursuant to section 39-13-506 it appears that your boyfriend could be charged with a class E felony. However, the fact that he COULD be charged does not mean that he will be. A lot may depend on whether or not he is able - and willing - to support you and the child.

Whether or not he goes to jail has nothing whatsoever with how old you are when the child is born.

I think it unlikely that a prosecutor would pursue a statutory rape case if the sex act that is prosecuted took place just 3 weeks before age 18. That would be a tough sell to most jurors, I think. But certainly the prosecutor could try if he or she felt he/she could win a conviction. But first the prosecutor or police would have to learn of it. Is someone going to file a complaint about the statutory rape? If not, it’s very unlikely they’ll ever learn of it, let alone prosecute it.

He could if someone reported him because he had sex with you while you were under the age of consent. It doesn't matter when the baby is born - it matters when he had sex with you.
