    Can I Move Out of My Parents House Under the Age of Majority into My Own Apartment
    My question involves juvenile law in the State of: Maryland

    I've been looking at a lot of stuff online, but not a lot of people post about trying to move out WITH parental consent. So, is it possible that I could move out into an apartment by myself under 18 with parental consent? I'm 17 now and my birthday is in a few months, but the situation is so bad at home that I don't think I can wait that long. My parent is fully supportive of me trying to move out. Any relevant information would really help!!

    I note you say you have one parent who is supportive of this. What about the other parent? I believe you need permission from both parents for this to work.

    That said, you may move out to an apartment with both parents' consent. However, your parents will have to sign the lease and any other contracts (think phone, cable, utilities etc.) you require on your behalf, and remain financially responsible for you, until you turn 18. Finally, you may have some difficulty finding a landlord willing to rent an apartment to someone who's under 18. While this would be age discrimination, it would be legal age discrimination.

    My parents are divorced and the other parent doesn't have any custody

    I believe the other parent still has to consent. In law, non-custodial parents are still legally parents.

    There are others here who will know more about this particular aspect. Wait for them to weigh in.

    So, which parent is in favor and which is not?

    I'm getting the impression that it may be the non-custodial parent saying yes, and the custodial parent saying no. In which case, the answer is No.

    The consent of both wouldn’t be needed. If that were the case, one parent could always block the other when it came to issues involving their kids. If the custodial parent agrees, then it wouldn’t be a problem unless and until the noncustodial parent went to court and got an order from a judge saying the custodial parent cannot allow the child to live in that apartment. The noncustodial parent would still be entitled to whatever visitation he or she has, however. If the custodial parent is the one who objects, that’s clearly a problem since that parent is entitled to custody and that means insisting the child live with him or her. If the noncustodial parent disagrees and wants to have the kid in the apartment, he or she can again go to court and seek the appropriate order. But good luck to the noncustodial parent on that one. ;)

    You are better off just waiting until you are 18 to move out. If the custodial parent is saying no, you can't move. Period. If the custodial parent says yes then fine - but that parent is signing for all the things mentioned.

    Is it really "that bad" or is it "bad" in a teenager's mentality of "my parents suck?" What is the "situation" at home? Are you being abused? Neglected? If so go report it. If not, suck it up for a few more months.

    It is the custodial parent that is agreeing so I don't think it's a problem there. And yes it really is that bad and I have on multiple occasions reported the things that my parent has done to no avail. Cps looked into it, but determined my current custodial parent was still the more stable parent.

    So what is going on that is so bad? What has your custodial parent done to you? If CPS looked into it and said your CP is the "more stable parent" than what the hell is your non custodial parent involved in?

    If your custodial parent says yes then you can - but you will be hard pressed to find a landlord who will rent to a 17 year old. Also your custodial parent is going to have to sign all contracts as already stated because YOU cannot legally enter into any contract. Is your parent willing to risk signing a lease to an apartment and other contracts for you? I doubt it. So you actually may just have to wait until you're 18 so you can legally sign these things yourself.

    I suspect there's another adult involved in this equation. One who, perhaps, is over 18 and doesn't need permission or other help to rent an apartment. :cool:

    I echo the suggestion of waiting for a couple of months. If OP has lived there so far, another couple of months isn't long to wait.

    The impatience of youth ... le sigh.
