Ex Will Not Sign Mediation Agreement, May Not Return Child
My question involves a child custody case from the State of: LA/SC

I have relocated to SC from LA. We signed a consent agreement and filed it with the court in LA. We could not agree on how our daughter was to be transported from his house to mine at the end of his time with her. We attended mediation at his request. I did not bring my attorney. He did bring his. We came to an agreement regarding transportation. His attorney refused to draw up a CJ to file regarding our mediated agreement, so I had mine do it. He has not signed the agreement. We are supposed to meet to exchange custody in a week. I am afraid that he will 1. Refuse to follow through with what we agreed to in mediation 2. refuse to give me my daughter. Our signed CJ does say he has to give her to me, but it will mean I have to drive the entire 700 miles if he decides not to show up as agreed in our mediation. Is there any recourse? Thanks.

Since you created the distance, why should you NOT drive the entire distance?

Unless you have something signed by a judge? You have nothing enforceable.

    Sure.

If that happens, you go back to court AFTER it happens.

And I have to agree with Jumanji. YOU took your daughter to another state, it's up to you to get her back and forth to her father.

If you don't like the drive, you shouldn't have moved that far away.
