A prosecutor, looking at the full facts, might perceive the person who is claiming to have been a bystander as having been involved in the crime -- as having aided, assisted, helped with, or otherwise being involved in the drug sale. However, if a person is present at the crime scene but has no connection to the drug transaction, without additional evidence of involvement the person should not be convicted.
