Can You File for Child Support Without the Father's Getting Visitation
Following a divorce, a man who was living with his family in California left the household and returned to his nation of origin. A year later he came back to the U.S. The mother wants to receive child support, but does not want the man to have visitation rights, due to his bad temper and untrustworthiness. Can she get child support without his getting any visitation?
Re: Can You File for Child Support Without the Father's Getting Visitation
The mother can request a child support order without requesting that the father be granted visitation. However, if the father wants visitation and asks the court to issue a visitation order, it will be difficult for the mother to convince a court to deny any visitation. Even terrible parents can be awarded supervised visitation with their children. Courts prefer to allow children to have contact with both parents.
