Child Support With No DNA Test
A man in Georgia signed an affidavit of parentage for a child when the baby was born. He asked for a DNA test, but the mother said "no". Two years later she filed for child support. He asked the judge for a DNA test and the judge denied his request. What can he do?
Re: Child Support With No DNA Test
If he has visitation, nothing is stopping him from getting a DNA test. All it takes is for him to get the cheek swabs and pay the fee.
The issue is, he's too late to rescind the AOP and a judge has already held that it's too late for him to try to challenge his admission of paternity based on a DNA test. Even if the DNA test indicates that somebody else is the father, the court is likely to continue its prior finding.
He should consult a family lawyer with the full facts and history of the case.
